Terms of Service

1. Agreement to terms

By accessing or using SellWisely ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by BuyWisely Pty Ltd ("we", "us", "our").

2. Description of Service

SellWisely is a price intelligence platform that helps Australian retailers compare their product prices against competitors. We aggregate publicly available pricing data from online retailers and present it in an actionable format.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account.
• One person or entity per account. Shared accounts are not permitted.
• You must be at least 18 years old to use the Service.

4. Free and paid plans

• The free plan provides limited access to the Service (up to 5 tracked stores, 200 products per store).
• Paid plans (Pro) are billed monthly or annually via Stripe. Prices are in USD.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• We do not offer refunds for partial billing periods.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to scrape, crawl, or extract data from the Service by automated means beyond what the Service provides.
• Resell or redistribute data obtained from the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate another person or entity.

6. Data accuracy

We strive to provide accurate and up-to-date pricing information, but we do not guarantee the accuracy, completeness, or timeliness of any data. Pricing data is collected from publicly available sources and may contain errors or be out of date. You should verify pricing independently before making business decisions.

7. Intellectual property

The Service, including its design, features, and content (excluding third-party pricing data), is owned by BuyWisely Pty Ltd. You may not copy, modify, or create derivative works of the Service without our written permission.

8. Limitation of liability

To the maximum extent permitted by Australian law, the Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits or business decisions made based on pricing data.

9. Termination

We may suspend or terminate your account at any time if you violate these terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.

10. Changes to these terms

We may modify these terms at any time. We will notify you of material changes by email or by a notice on the site. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
